The DUI Court Process

There are multiple stages of a DUI case, and it begins with your appearance at an arraignment.  This will be the first time you appear at Salem District Court. The judge will read the charges that have been filed against and ask you to enter your plea of guilty or not guilty.  After entering your plea, the judge will then set a date for the pre-trial conference.   Based on the circumstances of your arrest, you and your attorney can decide to accept a plea bargain from the District Attorney (which usually involves pleading guilty to a lesser offense, i.e. reckless driving, in exchange for avoiding additional prosecution), or move forward to trial, where your case will be tried before a judge and jury.
